All claims must arbitrated on an individual basis, and cannot be consolidated in any arbitration with any claim or controversy of anyone else. All arbitration must occur in Ontario, Canada. Each party shall bear one half of the arbitration fees and costs incurred, and each party is responsible for its own lawyer fees.

13. REFUNDS AND FILE ACCESS

Unless otherwise specified, all direct downloads and products include a 30 day money back guarantee. Refunds requested on the 31st day cannot be processed. In order to ensure your refund requests are processed in a timely manner, please do not wait until the last few days to submit a refund request. To obtain a refund, please open a support ticket at support@thecottonspa.ca, and include the email address you used to purchase.

Subscription based software, services, and products such as Membership are not eligible for refunds but can be cancelled anytime. To cancel any subscription based service, please open a ticket at our help-desk within three business days prior to your re-bill date. In most cases, you can also cancel your subscription directly from your PayPal profile. Please do not open support tickets for products not eligible for refunds. Products and direct download purchases may not be accessible in perpetuity. You are responsible for accessing, downloading, and reviewing the materials within the first 30 days of purchase. Any used or open products are not eligible for refunds, unless specified at the time of purchase. Manufacturing recall or defects are eligible for exchange only.

The Cotton Spa applications collect some information anonymously. This can include the app and version number, language, OS version and license data. This is solely used to ensure correct content is shown in the welcome screen of the applications and to identify a possible update notification.

We will also collect crash report data, but only if you choose to submit it to us.

In addition to this our beta versions of the applications will automatically send additional data to help diagnose issues including GFX card information, Direct X data, CPU info and platform patches.

11. VISITORS’ GDPR RIGHTS

If you are within the European Union, you are entitled to certain information and have certain rights under the General Data Protection Regulation.

Those rights include:

We will retain the information you choose to provide to us until the earlier of:
(a) you asking us to delete the information,
(b) our decision to cease using our existing data providers, or
(c) the Company decides that the value in retaining the data is outweighed by the costs of retaining it.

You have the right to request access to your data that the Company stores and the rights to either rectify or erase your personal data.
You have the right to seek restrictions on the processing of your data.
You have the right to object to the processing of your data and the right to the portability of your data.

To the extent that you provided consent to the Company’s processing of your personal data, you have the right to withdraw that consent at any time, without affecting the lawfulness of processing based upon consent that occurred prior to your withdrawal of consent.
You have the right to lodge a complaint with a supervisory authority that has jurisdiction over issues related to the General Data Protection.

12. Regulation.

We require only the information that is reasonably required to enter into a contract with you. We will not require you to provide consent for any unnecessary processing as a condition of entering into a contract with us.

THE COTTON SPA CANCELLATION POLICY

ATTENTION
Most of our services require preparation time to properly prepare the room for your treatment. Preparations may include the use of products. Due to the timing, cost of preparations, and to hold the room in anticipation of your visit, we kindly ask for the following considerations when booking and canceling an appointment.

We kindly ask you to provide us with at least a 24-hour notice for all appointment cancellations. Due to COVID-19 for your convenience appointments can be canceled up to 4 hours before your appointment time.
No shows or same-day cancellations that are less than 4 hours of your appointment time, 50% of the service will be charged in order to reschedule.
For Gift Certificates, 50% of the service value will be redeemed.
For Packages 50% of a single service value, at its regular price, will be redeemed.

Complimentary services:

No shows or same-day cancellations that are less than 4 hours of your appointment time, to re-book there will be a $25 Consultation fee.
Services that require a Credit card hold in order to book the service (such as longer services or multiple services, or any other reasons we would've taken a credit card hold) that are not canceled within 4 hours will be charged 50% on all services booked.
Services longer than 2 hours or services booked for multiple persons that amount to longer than 2 hrs, will require a credit card to book the appointment.

If you book online, you will receive a phone call for credit card authorization to hold your appointment time. Your credit card will not be charged and you may pay in another method at the time of your appointment. Charges on your credit card will only occur based on the cancellation policy above.

Spa Etiquette

ARRIVAL
Please arrive at your scheduled appointment time. New clients will have a form to fill out and a consultation will be done before starting your service. This is factored into your appointment time so that you do not have to arrive earlier. Arriving early will not guarantee your service will start before your scheduled appointment time. Please call or email ahead to check if your service can be started before the scheduled time.

SICKNESS AND ALLERGIES
If you show up for an appointment and are sick or getting over a sickness, or show signs of severe allergies, this includes but is not limited to coughing, sneezing, and congestion, you will be refused service and will be charged to re-book an appointment.

*NOTE: It is not advised that someone with severe allergies to get a facial at that time, as the skin can be more reactive and sensitive to products used in treatments.

LOST OR STOLEN ITEMS
The Cotton Spa is not responsible for lost or stolen items. Please keep all personal items with you.

GIFT CERTIFICATES
Gift Certificates are not refundable, not transferable, or redeemable for cash or credit. Please review all terms and conditions.

TAXES & GRATUITIES
13% HST will be added to your services and packages. Gratuities are at the discretion of the guest. Prices and services are subject to changes without notice.

YOUR HEALTH
Before your service, you may be required to complete a Guest Pre-Treatment Form to safeguard your well-being and comfort.
The Cotton Spa assures and maintains confidentiality of the strictest standards.

PRIVATE EVENTS & PARTIES
All group bookings or spa parties require one week's notice for any changes or cancellations or a 100% service fee charge will be applied for any no-show or late cancellations.
To ensure the maximum safety of all our valued guests, we are taking additional precautionary measures including:
• Complete disinfecting of all equipment used during services
• Routine wipe-down of chairs, as well as all other touch-points
